Indian Government’s latest announcement has proposed revoking the special constitutional status of Kashmir, amid a heavy security crackdown. The centre revoked Article 370 which gave special status to Jammu and Kashmir and proposed that the state be split into Jammu & Kashmir and Ladakh- two union territories.

What is Article 370?
Jammu and Kashmir’s special status in the Indian Union is defined particularly under Article 370 of the constitution.
When India gained independence in 1947, Jammu and Kashmir initially chose to remain independent and signed agreements with India and Pakistan. However, post an invasion from Pakistan, the state signed an Instrument of Accession with Union of India.
It was proposed that only –
- Defense
- Foreign Affairs
- Communications related provisions of the Indian constitution would apply to the State.
Article 370 permits the state to draft its own constitution and also restricts the Indian Parliament’s legislative powers on the state.
What is Article 35A?
Article 35A permits the local legislature in Indian-controlled Kashmir to define the permanent residents of the region.
It forbids Indians from outside the state from buying land, holding local government jobs or getting education scholarships or permanently settling in the region.
What is the status post revoking Article 370?
The revoking of Article 370 will “completely integrate” the state with the Indian Union and its residents will enjoy all the equal rights like other citizens.
And with the abrogation of Article 370, Article 35A will automatically become void, thereby annulling the special status enjoyed by the residents over land, business, and employment.
